Governing Law: These Terms & Conditions shall be governed by and construed in accordance with the laws of England and Wales. Any dispute arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
Consumer Rights: Nothing in these Terms shall affect the statutory rights of consumers under applicable Spanish or EU law, which take precedence where mandatory.
Tourism Regulations: ALTIVELO provides guided cycling activities in Mallorca and complies with Spanish “Turismo Activo” requirements, including holding appropriate civil liability insurance and adhering to Balearic Islands tourism regulations.

1. General Provisions
1.1. By booking or renting a bicycle, participating in an organised tour, or engaging in a private cycling tour with ALTIVELO, the Client acknowledges that they have read, understood, and agreed to these Terms & Conditions in full.
1.2. The Client must be at least 18 years of age to enter into any rental or tour agreement. Minors may only participate under the supervision and legal responsibility of a parent or guardian.
1.3. ALTIVELO reserves the right to refuse service, remove participants, or terminate any agreement if these Terms & Conditions are breached.
1.4. Clients are responsible for having personal travel insurance covering cycling, accident, medical treatment, and theft.

2. Bike Rental Terms
2.1. Security Deposits
•A refundable deposit applies to all rentals, category-specific and communicated prior to booking.
•Deposits will be refunded within 14 calendar days of the safe and timely return of the bicycle, subject to inspection.
•Deductions may be made for damages, losses, late return fees, or other breaches of these Terms.
2.2. Cancellations
•48 hours or more before rental start: Full refund.
•Less than 48 hours before rental start: 50% refund.
•Less than 24 hours before rental start: No refund.
2.3. Delivery & Collection
•Any change of delivery or collection address after booking confirmation will incur a fee of €1.50 per kilometre from the original agreed address.
2.4. Use of Bicycle
•The Client must use the bicycle responsibly and only for its intended purpose.
•No modifications to bicycles are permitted.
•Helmets must be worn at all times in accordance with Spanish law.
2.5. Bike Setup Liability
•The Client is responsible for providing accurate bike size and setup details.
•ALTIVELO accepts no liability for injury, accident, or loss arising from incorrect measurements or setup information supplied by the Client.
2.6. Damages, Repairs & Incidents
•The Client is liable for all damages during the rental period, charged at component market value and repair cost.
•Late returns:
•Up to 2 hours late: €30 fee.
•More than 2 hours late: full additional daily rental rate applies.
•Any incident, accident, theft, or damage must be reported immediately.
•If a defect not caused by the Client arises:
•ALTIVELO will provide a replacement bicycle where available.
•If no replacement is available, a pro-rata refund will apply.
•If at the start of the rental and no replacement is available, a full refund will be issued.
2.7. Loss, Theft, or Irreparable Damage
•In the event of theft, total loss, or damage beyond repair, the Client shall be liable for:
a) The full replacement value of the bicycle (current retail price).
b) Compensation for 14 days of lost rental income.
2.8. Liability Disclaimer
•Cycling carries inherent risks. The Client accepts full responsibility for their own safety when using ALTIVELO bicycles.
•ALTIVELO shall not be held liable for injury, accident, death, or loss, except where caused by gross negligence or willful misconduct, as required under Spanish/EU law.

3. Organised Tours (3 events per year, 5 days each)
3.1. Participation Rules
•Tours take place on open public roads. Clients must:
•Adhere to all local traffic laws and the road code.
•Wear a certified helmet at all times (mandatory under Spanish law).
•Be sober and within legal alcohol limits when riding.
•Ride responsibly and follow the guidance of ALTIVELO staff and guides.
•ALTIVELO reserves the right to immediately remove any participant engaging in reckless, dangerous, or illegal behaviour, with no refund provided.
3.2. Cancellations
•Up to 60 days before event start: 50% refund.
•Less than 60 days before event start: No refund, unless the place is re-sold.
•If the place is re-sold, a refund will be issued less a 5% administration fee.
3.3. Liability Disclaimer
•The Client acknowledges that cycling on open roads is a high-risk activity.
•ALTIVELO, its directors, employees, contractors, and partners accept no liability for injury, accident, loss, or death, except where prohibited by law.
•Participation is at the Client’s own risk and suitable insurance is strongly recommended.

4. Private Cycling Tours
4.1. Participation Rules
•Clients must comply with all local traffic laws and the road code.
•Clients must be sober and below the legal alcohol limit when riding.
•Clients must act responsibly within the group and follow the guide’s instructions.
•ALTIVELO reserves the right to terminate any ride due to reckless or dangerous behaviour, with no refund issued.
4.2. Cancellations
•7 days or more prior to start date: 75% refund.
•Less than 7 days before start date: 50% refund.
•Less than 48 hours before start date: No refund.
•The first day of the booked tour is treated as the start date for all notice periods.
•Date modifications and day cancellations are treated as cancellations and subject to the same refund schedule.
4.3. Liability Disclaimer
•The Client accepts all liability for injury, accident, damages, or losses arising from participation in private cycling tours.
•The Client agrees to hold harmless ALTIVELO, its directors, suppliers, contractors, and partners, except in cases of ALTIVELO’s gross negligence or willful misconduct.

5. Governing Law & Jurisdiction
These Terms & Conditions are governed by the laws of England and Wales. The parties agree that the courts of England and Wales shall have exclusive jurisdiction over disputes.
However, nothing in these Terms shall restrict the rights of consumers under mandatory Spanish or EU law, which may apply where services are provided in Mallorca.
