GOVERNING LAW & JURISDICTION
These Terms & Conditions are governed by and construed in accordance with the laws of England and Wales.
Where services are delivered in Spain or the United Arab Emirates, mandatory provisions of applicable local consumer or civil law shall apply where required and shall take precedence to the extent legally necessary.
Any dispute arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales, except where mandatory local law requires otherwise.
1. GENERAL PROVISIONS
1.1 By booking a cycling experience, curated event, private experience, or bicycle rental with ALTIVELO, you confirm that you have read, understood, and agreed to these Terms.
1.2 The contracting party must be at least 18 years of age. Minors may only participate with written parental or legal guardian consent.
1.3 ALTIVELO reserves the right to refuse participation or terminate services where a participant behaves in a dangerous, unlawful, or disruptive manner.
1.4 Participants are responsible for arranging appropriate travel and personal insurance covering cycling activity, accident, medical expenses, cancellation, and theft.
2. BICYCLE RENTAL TERMS
2.1 Security Deposit
• A refundable security deposit applies to all rentals.
• The amount is confirmed prior to booking.
• Deposits are refunded within 14 calendar days following inspection and safe return of the bicycle.
• Deductions may apply for damage, missing components, excessive wear, or late return.
2.2 Cancellations (Rentals)
• 72 hours or more before rental start: Full refund
• 24–48 hours before rental start: 50% refund
• Less than 24 hours before rental start: No refund
2.3 Use of Bicycle
• The bicycle must be used responsibly and lawfully.
• No structural modifications are permitted.
• Helmets must be worn in accordance with local law in Spain or the UAE, as applicable.
• The client is responsible for safe storage during the rental period.
2.4 Damage, Theft & Loss
The client is responsible for damage occurring during the rental period, excluding normal wear and tear.
In the event of theft or total loss:
• The client may be liable for the fair market replacement value of the bicycle.
• Reasonable compensation for loss of use may apply where permitted by law.
All incidents must be reported immediately to ALTIVELO and, where appropriate, local authorities.
2.5 Limitation of Liability (Rentals)
Cycling carries inherent risks.
ALTIVELO shall not be liable for injury, accident, or loss arising from normal participation in cycling activities, except where caused by proven negligence or breach of statutory duty.
Nothing in these Terms excludes liability where it cannot legally be excluded under applicable law.
3. CURATED CYCLING EVENTS & EXPERIENCES
(Mallorca & UAE)
3.1 Nature of Services
ALTIVELO provides curated private cycling experiences and limited group events delivered on open public roads in Mallorca and the UAE.
Participants remain individually responsible for:
• Compliance with local traffic regulations
• Safe riding conduct
• Personal physical readiness
• Adherence to safety briefings
3.2 Participation Rules
Participants must:
• Follow all local road and traffic laws
• Wear a certified helmet where required by law
• Ride within legal alcohol limits
• Act responsibly toward other road users
ALTIVELO may remove participants engaging in unsafe or unlawful behaviour.
3.3 Payment & Cancellation (Experiences)
A 50% deposit secures the booking.
• 7+ days prior: Deposit retained, balance refunded
• 72 hours prior: Deposit retained, no further refund
• 24 hours or less: 100% fee payable
All cancellations must be submitted in writing.
ALTIVELO may, at its discretion, offer date transfers subject to availability.
3.4 Risk Acknowledgement
Participants acknowledge that road cycling in Spain and the UAE involves inherent risks including traffic hazards, weather conditions, road surface variations, and physical exertion.
Participation is voluntary and undertaken at the participant’s own risk.
3.5 Limitation of Liability (Experiences)
To the fullest extent permitted by law:
• ALTIVELO – JM Managment & Consultancy LTD, its directors, contractors, partners and suppliers shall be held harmless and not be liable for injury, loss, damage, or death arising from inherent risks of cycling.
• Liability is limited to cases of proven negligence or breach of statutory duty.
Nothing in these Terms limits liability where exclusion is prohibited by law in Spain, the UAE, the UK, or under applicable EU regulations.
4. FORCE MAJEURE
ALTIVELO shall not be liable for failure to perform obligations due to events beyond reasonable control, including but not limited to:
• Extreme weather
• Government restrictions
• Public health measures
• Road closures
• Civil unrest
• Natural disasters
In such cases, reasonable alternative arrangements or credits may be offered.
5. SEVERABILITY
If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain valid and enforceable.
